Comprehensive legally binding terms for Prescription. Outlines statutory intermediary neutrality, direct bilateral doctor-patient covenant, 100% free clinician practice guarantee, and cryptographic health data protection.
Prescription operates strictly and exclusively as a neutral technological communication bridge and software infrastructure provider. Prescription is NOT a medical clinic, hospital, diagnostic center, or employer/agent of healthcare professionals, and does NOT practice medicine or dispense medical diagnosis.
🤝 Direct Bilateral Covenant
All clinical diagnoses, prescriptions, and opinions exist strictly between the independent physician and patient.
🛡️ Voluntary Mutual Consent
Patients and doctors connect entirely at their own mutual discretion and informed consent.
⚖️ Absolute Platform Immunity
Prescription holds zero clinical liability. All clinical accountability rests with the licensed physician.
Technology Infrastructure Only: Prescription is a secure, multi-tenant digital healthcare infrastructure network designed to facilitate:
Intermediary Status: Prescription operates strictly as a technology platform and software service provider. Prescription does not practice medicine, provide medical advice, or operate as a licensed pharmacy.
Doctor's Sole Clinical Responsibility: The attending medical practitioner assumes 100% exclusive clinical, statutory, and professional responsibility under the Bangladesh Medical and Dental Council (BMDC) Act, 2010 for all diagnostic evaluations, prescriptions, and advice rendered.
Patient's Sole Responsibility: The patient assumes full responsibility for disclosing complete, accurate medical histories, known drug allergies, active medications, and following the clinician's guidance, including seeking immediate in-person hospital care when required.
NOT FOR MEDICAL EMERGENCIES: THE PLATFORM IS NOT DESIGNED, INTENDED, OR SUITABLE FOR EMERGENCY MEDICAL SITUATIONS, SEVERE TRAUMA, ACUTE CHEST PAIN, RESPIRATORY DISTRESS, OR CRITICAL LIFE-THREATENING CONDITIONS.
In the event of a medical emergency, you must immediately visit the nearest hospital emergency room, specialized trauma center, or contact national emergency response services (e.g., 999).
All doctors utilizing the Platform represent and warrant that they hold active, valid registration with the Bangladesh Medical and Dental Council (BMDC). Clinicians deliver consultations strictly in accordance with:
In strict compliance with Directorate General of Drug Administration (DGDA) regulations and the Narcotics Control Act, Schedule/Controlled substances must NEVER be dispensed without a valid, cryptographically verified digital prescription.
Immutable SHA-256 Sealing: Every prescription generated on the Platform is stamped with an immutable SHA-256 cryptographic content hash and dynamic QR code matrix. Any post-generation tampering immediately invalidates the signature.
AES-256 & TLS 1.3: All Protected Health Information (PHI) is encrypted at rest with AES-256 and transmitted with TLS 1.3 encryption.
Right to be Forgotten: Upon verified deletion requests, the Platform executes crypto-shredding—permanently destroying the individual cryptographic encryption keys, rendering stored clinical data permanently unrecoverable.
Users and practitioners are solely responsible for maintaining the confidentiality of login credentials, two-factor authentication (2FA) OTP tokens, and biometric security keys.
Sessions automatically lock after periods of inactivity to prevent unauthorized access in clinical environments. Any detected brute-force attempt results in immediate rate-limiting and temporary account lockout.
100% Free Forever Clinician Guarantee: Prescription provides 100% lifetime complimentary access to all registered medical practitioners (BMDC holders). Doctors NEVER pay setup fees, software subscriptions, or per-prescription fees. Doctors retain 100% of their consultation visit fees.
Sustainable Platform Funding: To support encrypted cloud infrastructure, WebRTC HD video calling, and 24/7 technical operations, a standard platform service fee of ৳27 (Twenty-Seven Bangladeshi Taka) is charged to the patient at consultation/serial confirmation.
If a scheduled clinician is unable to consult within 60 minutes of the appointment window, the patient is entitled to a full refund processed back to the original payment source within 7 to 14 business days.
Voluntary patient cancellations requested more than 2 hours prior to scheduled consultation are eligible for full consultation fee refunds minus the nominal platform processing surcharge.
All platform UI components, source code, database architecture, cryptographic sealing algorithms, logos, trademarks, and documentation are the exclusive intellectual property of Prescription and Infosphere.
Medical practitioners retain full ownership of their individual clinical diagnostic notes, prescription templates, and professional authored content.
To the maximum extent permitted by applicable law, Prescription shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of medical decisions, diagnostic inaccuracy, drug interactions, or internet connectivity disruptions.
The Platform operates on an "as is" and "as available" basis without warranties of uninterrupted service availability.
You agree to defend, indemnify, and hold harmless Prescription, its officers, directors, employees, and software engineering affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable legal fees) arising out of:
In the event of any controversy, claim, or dispute arising out of or relating to this Agreement or breach thereof, the parties shall first attempt in good faith to resolve the matter amicably through direct conciliation within thirty (30) business days.
If unresolved, the dispute shall be finally settled under the Arbitration Act, 2001 (Act No. 1 of 2001) of Bangladesh. The arbitration tribunal shall consist of a sole arbitrator appointed by mutual consent, and the legal seat and venue of arbitration shall be Dhaka, Bangladesh. The language of arbitration shall be English.
This Agreement, the Neutral Intermediary Charter, and all related platform policies shall be governed by, construed, and enforced in accordance with the substantive laws of the People's Republic of Bangladesh.
Subject to Section 14 (Arbitration), the competent courts situated in Dhaka, Bangladesh shall have exclusive territorial jurisdiction over any legal proceedings arising hereunder.
